Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Canopath website, applications, and software services (together, the "Service"). The Service is operated by Krilaha Immigration Services Inc., doing business as Canopath ("Canopath", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Canopath is — and what it isn't
Canopath is a self-serve software tool that helps individuals prepare their own applications to Immigration, Refugees and Citizenship Canada (IRCC), starting with visitor visa (TRV) applications. The Service may, at our discretion, expand to additional Canadian immigration application types over time.
Canopath is not your immigration representative. Under the Immigration and Refugee Protection Act (IRPA) and the rules of the College of Immigration and Citizenship Consultants (CICC), only authorized representatives — Canadian immigration lawyers, paralegals (in Ontario), notaries (in Quebec), and Regulated Canadian Immigration Consultants (RCICs) — may give legal advice or represent you to IRCC for a fee or other consideration. Canopath does not do these things. We provide:
- General information and educational content about Canadian immigration;
- A self-serve questionnaire that you complete with your own answers;
- Software that organizes your information into IRCC's standard forms;
- Software that auto-fills your information into IRCC's online portal, which you review and submit yourself.
If you select our "Plus" or "Premium" tier, an independent licensed RCIC ("Reviewing RCIC") will review your application before submission. In that case, the Reviewing RCIC, not Canopath, becomes your representative for the limited purpose of that review, and is named on IRCC Form IMM 5476. Canopath facilitates this introduction; we are not a party to your representation agreement with the Reviewing RCIC.
2. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract under the laws of your jurisdiction to use the Service. By using the Service, you represent that:
- You are 18 or older (or the age of majority in your jurisdiction, whichever is greater);
- The information you provide is true, complete, and accurate to the best of your knowledge;
- You will keep your account credentials confidential and notify us promptly if you suspect unauthorized access; and
- You are using the Service for your own application, or for the application of an immediate family member for whom you have authority to act under applicable law.
3. Account registration
To use most features of the Service, you must create an account. You agree to provide accurate information at signup and to keep it current. You are responsible for all activity that occurs under your account, whether you authorized it or not. We reserve the right to suspend or terminate accounts that we reasonably believe are involved in fraudulent activity, attempts to impersonate another person, or violations of these Terms.
4. Acceptable use
You agree not to:
- Use the Service to prepare or submit a fraudulent immigration application;
- Misrepresent your identity, citizenship, family relationships, employment, financial means, background, or any other material fact;
- Attempt to access another user's account or data;
- Reverse-engineer, decompile, or disassemble any part of the Service;
- Scrape, mass-download, or systematically extract data from the Service;
- Use automated tools or scripts to interact with the Service in a manner inconsistent with normal browser-based use;
- Resell, license, or sublicense the Service to third parties;
- Hold yourself out as an immigration representative on the basis of having used Canopath; or
- Use the Service in violation of any applicable law, including export control laws, sanctions, or anti-money-laundering regulations.
You acknowledge that misrepresentation to IRCC carries serious consequences under IRPA, including a five-year inadmissibility ban for findings under section 40(1)(a). Canopath cannot detect misrepresentation in your inputs, and we expressly disclaim responsibility for the truthfulness of information you submit.
5. Fees, plans, and payments
Pricing for our paid plans is published at /pricing. Plans are billed as one-time fees, in Canadian Dollars, and are payable when you choose to download your finished application materials.
Payments are processed by Stripe Payments Canada, Ltd. ("Stripe"). By providing payment information, you authorize Canopath, through Stripe, to charge the applicable fee. Canopath does not store your full payment card data; Stripe handles all PCI-scoped processing.
The IRCC application fee is not part of our fee. You pay IRCC's government application fee (currently CAD $100 per visitor visa applicant, subject to change by IRCC) directly to IRCC during submission on IRCC's portal. Canopath does not collect, process, or remit IRCC fees.
Plan upgrades may be available; downgrades and partial refunds are governed by Section 6.
6. Refunds
Our refund commitments are set out in detail in our Refund Policy, which is incorporated into these Terms by reference. In summary:
- We refund in full where our software fails to deliver the functionality described on the Service ("Software Failure Refund");
- We do not refund based on IRCC's decision on your application. Visa, refusal, and approval decisions are made solely by IRCC, and Canopath does not control, predict, or guarantee any outcome.
7. RCIC review (Plus and Premium tiers)
If you purchase the Plus or Premium tier, a Reviewing RCIC will review your application materials and provide a written summary of strengths, gaps, and recommended improvements (Plus), and additionally a 30-minute video consultation (Premium). When you purchase one of these tiers, you separately enter into a representation agreement with the Reviewing RCIC, who will be named on IRCC Form IMM 5476 ("Use of a Representative") and bound by the CICC Code of Professional Ethics.
Canopath introduces you to the Reviewing RCIC and provides the platform on which the review is delivered. Canopath is not a party to the professional-services relationship between you and the Reviewing RCIC, and we expressly disclaim liability for the substance, accuracy, timeliness, or outcome of the Reviewing RCIC's professional advice. Disputes regarding the Reviewing RCIC's services are between you and that RCIC, subject to the CICC's complaint process.
8. Use of artificial intelligence
The Service uses artificial intelligence (AI) systems — currently large language models operated by Anthropic, PBC ("Anthropic") — to:
- Extract information from documents you upload (e.g., a passport scan);
- Draft letters of explanation based on your questionnaire answers;
- Map your data to IRCC form fields;
- Auto-fill the IRCC online portal via a browser extension you control.
AI outputs are generated automatically and may contain errors, omissions, or hallucinations. You are responsible for reviewing all AI-generated content for accuracy before submitting any application or document to IRCC. We provide review and edit functionality at every stage; you are expected to use it.
Anthropic processes your data per its commercial terms and does not use your data to train its models. See our Privacy Policy for the full subprocessor list.
9. Browser extension
The Canopath browser extension is provided as part of the Service for the limited purpose of auto-filling the IRCC online portal at tr-rt.apps.cic.gc.ca and portal-portail.apps.cic.gc.ca using data from your application. The extension does not collect data from any other website, does not transmit data to third parties, and does not submit your application to IRCC. You remain responsible for clicking "Submit" on IRCC's portal yourself.
10. Your content and license to us
The questionnaire answers, documents, and other materials you provide to the Service are your "Content". You retain all ownership of your Content. You grant Canopath a limited, non-exclusive, royalty-free, worldwide license to host, store, process, transmit, display, and use your Content solely for the purpose of providing the Service to you. This license terminates when you delete your Content or close your account, except as required for legal retention (Section 14) and security backups for a reasonable rolling period.
We do not use your Content to train AI models, sell your Content to third parties, or use your Content for marketing or promotional purposes without your express written consent.
11. Intellectual property
All software, content, branding, design, and materials of the Service (excluding your Content) are the property of Canopath or its licensors and are protected by Canadian and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal use, subject to these Terms.
12. Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, Canopath disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation. Without limiting the foregoing:
- We do not warrant that any application submitted to IRCC after using the Service will be approved, processed within any specific timeframe, or treated favorably by IRCC officers;
- We do not warrant that AI-generated outputs are free from errors or hallucinations;
- We do not warrant that the Service will be available continuously, error-free, or compatible with all browsers, devices, or operating systems;
- We do not provide legal, immigration, tax, financial, or professional advice. The Service is not a substitute for the professional judgment of a licensed RCIC or immigration lawyer.
13. Limitation of liability
To the fullest extent permitted by applicable law:
- Aggregate cap. Canopath's total cumulative liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the total amount you paid Canopath in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian Dollars (CAD $100).
- Excluded damages. Canopath is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business opportunities, lost data, or visa application outcomes, even if Canopath has been advised of the possibility of such damages.
- Mandatory rights preserved. Nothing in these Terms limits liability that cannot be limited under applicable law (such as the Quebec Consumer Protection Act or comparable mandatory consumer-protection legislation in your jurisdiction).
14. Indemnification
You agree to indemnify, defend, and hold harmless Canopath, its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, losses, costs, and reasonable legal fees arising from or related to: (a) your breach of these Terms; (b) misrepresentation, fraud, or unlawful activity in your application; (c) your violation of any applicable law, including IRPA; or (d) any infringement of third-party rights by Content you provide.
15. Term and termination
These Terms remain in effect while you use the Service. You may terminate at any time by closing your account from your account settings or by emailing [email protected]. Upon termination:
- Your access to the Service ends;
- We delete your Content within 30 days, except where retention is required by law (financial records: 6 years; CICC review records as required by CICC; security/audit logs as reasonably necessary);
- Pre-paid fees for services not yet delivered may be refundable per the Refund Policy;
- Sections of these Terms that by their nature should survive termination — including 4 (Acceptable Use), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 17 (Governing Law), 18 (Dispute Resolution), and this Section 15 — will survive.
We may suspend or terminate your access immediately if we reasonably believe you have breached these Terms, with or without notice. Where feasible we will give notice and an opportunity to cure.
16. Changes to these Terms
We may update these Terms from time to time. The "Effective" date at the top reflects the current version. For material changes (e.g., changes to dispute resolution, fees, or your rights), we will notify you by email at least thirty (30) days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may terminate your account before the effective date.
17. Governing law
These Terms and any dispute arising from them are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Where you are a resident of Quebec, the mandatory provisions of the Civil Code of Québec and the Consumer Protection Act (Quebec) apply to the extent they would otherwise.
18. Dispute resolution
Informal resolution first. Before filing any legal claim, you agree to first contact us at [email protected] with a written description of the dispute and your desired resolution. We will attempt in good faith to resolve the dispute within 30 days.
Forum. If the dispute is not resolved informally, the courts located in Toronto, Ontario have exclusive jurisdiction, except that you may bring small-claims-court matters in your own province of residence per the limits of that court.
No class actions. To the fullest extent permitted by law, disputes will be resolved on an individual basis. You agree not to participate in a class action, class arbitration, or other representative proceeding against Canopath. This waiver does not apply where prohibited by applicable provincial law.
19. General
- Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Canopath regarding the Service.
- Severability. If any provision is held invalid or unenforceable, the rest of the Terms remain in effect.
- No waiver. Failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or successor in connection with a corporate transaction.
- Notices. Notices to you may be sent to the email associated with your account; notices to us must be sent to [email protected].
- Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., natural disasters, war, internet outages, IRCC portal downtime, government actions).
- Language. The English version of these Terms is the authoritative version. A French translation may be made available for convenience; in case of conflict, the English version prevails, unless mandatory law (including Quebec's Charter of the French Language) requires otherwise.
